Terms of Service

These terms govern your use of newzwyre.com, the NewzWyre API (api.newzwyre.com), and any related tools we make available (the "Service"). The Service is operated by Chronic Internet LLC, a Hawaii limited liability company ("we", "us", "our"). By using the Service you agree to these terms. If you do not agree, do not use the Service.

The Service

NewzWyre is a media intelligence platform for public relations and communications professionals: a continuously refreshed database of media and PR contacts across 18 industries, an AI-assisted pitch-drafting tool, and wire distribution. The Service is offered on Free, Starter, Pro, and Agency tiers with different usage limits; current pricing and limits are shown at newzwyre.com/#pricing and may change from time to time.

Accounts and subscriptions

Paid subscriptions are billed through Stripe and can be cancelled at any time. Access continues through the end of your current paid billing period, and you will not be charged again after that period ends. We do not offer refunds for the current billing period. You are responsible for keeping your account credentials and API key confidential and for all activity under your account.

Contact-data accuracy

The media and PR contact information in our database is gathered automatically from public platforms and public directories and refreshed on an ongoing basis. It may be incomplete, out of date, or wrong at any given time, and it reflects public information, not information verified directly with each individual. It is provided for informational and outreach purposes only. You are responsible for verifying accuracy and appropriateness before relying on it or using it to contact anyone, and for complying with applicable law (including anti-spam law) in how you use it.

AI-generated pitch drafts

Our AI pitch-writing feature generates draft pitch emails using an automated large-language-model system, based on the information you provide. A generated draft is a starting point only. You are solely responsible for reviewing, fact-checking, editing, and approving any AI-drafted content before you send it under your own name or your organization's name. We do not warrant that AI-drafted content is accurate, appropriate for any particular recipient, or compliant with any law or platform policy.

Acceptable use

You may use the Service as licensed under your subscription tier. You may not:

• Circumvent rate limits, quotas, or authentication on the Service or the API.
• Scrape, bulk-export, resell, or republish the contact database, or a substantial portion of it, as a competing product or dataset.
• Use contact data obtained through the Service to send unsolicited bulk communications in a way that would violate CAN-SPAM, GDPR, or comparable law.
• Attempt to gain unauthorized access to any system, account, or network connected to the Service.
• Misrepresent your identity, or the origin of AI-drafted content, when contacting a media or PR professional found through the Service.

We may suspend or terminate access for any account or automated client that violates these terms, without notice.

Intellectual property

The Service, including its software, database compilation, and design, is owned by Chronic Internet LLC or its licensors and protected by copyright and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service under your subscription tier. All rights not expressly granted are reserved.

Third-party platforms and data

Our contact discovery draws on public data from third-party platforms, including YouTube, Spotify, Substack, Bluesky, Mastodon, GitHub, and public RSS feeds. We do not control those platforms, do not endorse them, and are not responsible for their content, accuracy, or availability.

No warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Limitation of liability

To the maximum extent permitted by law, Chronic Internet LLC and its members, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost business, or lost data, arising out of or relating to your use of or inability to use the Service.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of one hundred United States dollars (US$100.00) or the amount you paid us in the twelve months before the claim arose.

Indemnity

You agree to indemnify and hold harmless Chronic Internet LLC and its members, officers, employees, contractors, and agents from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising from your use of the Service, your violation of these terms, or your violation of any law or third-party right — including any pitch or communication you send using data or drafts obtained through the Service.

Eligibility and jurisdiction

You must be at least 18 years old to use the Service. We make no representation that the Service is appropriate or available in every jurisdiction; if you access it from elsewhere, you are responsible for compliance with local law.

Governing law and disputes

These terms are governed by the laws of the State of Hawaii, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or the Service will be brought exclusively in the state or federal courts located in the State of Hawaii, and you consent to the personal jurisdiction of those courts.

Changes

We may change these terms at any time. The effective date above reflects the current version. Continued use of the Service after a change takes effect means you accept the revised terms.

Miscellaneous

If any provision of these terms is held unenforceable, the remaining provisions stay in effect. These terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.
